Table of contents (16 sections)

This Acceptable Use Policy (the "Policy") sets out the rules that apply to everyone who accesses or uses the services of DCK Media & Business Consulting (Registration No. 202503147640 (PG0572109-H)), a business registered in Malaysia, operator of DCK VISIBILITY 360 ("DCK VISIBILITY 360", "we", "us" or "our"), including the Platform, our websites, the Apps, APIs, the Tracking Script, AI Output, reports and the Backlink Network (together, the "Services").

You are responsible for your content

DCK VISIBILITY 360 generates and publishes content on your instructions. Whether you use Auto-Publish or Review mode, you are responsible for every item of content published, sent or made available through your account, and for checking that it complies with this Policy and the law.

1. Scope and Relationship to the Terms#

1.1

This Policy forms part of, and is incorporated into, the Terms of Service. Capitalised terms not defined in this Policy have the meanings given in the Terms of Service. A breach of this Policy is a material breach of the Terms of Service.

1.2

This Policy applies to the Customer, its authorised users, and any person who accesses the Services through the Customer's account or credentials (each a "User"). The Customer is responsible for ensuring that all Users comply with this Policy and is liable for their acts and omissions as if they were its own.

1.3

This Policy applies to all content and activity on or through the Services, including Customer Content, prompts, AI Output, content published to websites, hosted blogs and Connected Accounts, messages sent through the Services, and the deployment of the Tracking Script.

1.4

The examples in this Policy are illustrative, not exhaustive. DCK VISIBILITY 360 may determine, in its reasonable discretion, whether any content or activity breaches this Policy.

2. General Principles#

2.1

When using the Services, you must:

  • (a)use the Services only for lawful business purposes and in compliance with all applicable laws and regulations, including laws on consumer protection, advertising, intellectual property, data protection, anti-spam, competition and sanctions;

  • (d)comply with the terms, policies and guidelines of every third-party platform you connect to or publish on through the Services; and
  • (e)provide accurate information to DCK VISIBILITY 360 and keep your account and Connected Account credentials secure.
2.2

You must not use the Services in any way that could harm DCK VISIBILITY 360, its infrastructure, its reputation, its relationships with third-party platforms or providers, or other customers, including by causing a third-party provider to restrict or revoke DCK VISIBILITY 360's access to its services.

3. Prohibited Content#

3.1

  • (e)makes health, medical, financial, investment, legal or other professional claims that are unsubstantiated, misleading or unlawful, including claims that a product cures, treats or prevents disease, or promises of guaranteed financial returns;
  • (f)advertises, sells or promotes regulated goods or services (such as alcohol, tobacco and vaping products, pharmaceuticals and supplements, firearms and weapons, gambling, financial and cryptocurrency products, and adult services) unless you hold all required licences and comply with all applicable laws and platform rules on their marketing, including age restrictions;
  • (g)promotes or sells illegal drugs, counterfeit goods, stolen goods, or other goods and services whose sale is prohibited;

DCK VISIBILITY 360 will immediately remove such content, terminate the associated accounts without notice or refund, preserve relevant information, and report the matter to the competent law-enforcement authorities and child-protection organisations.

4. Prohibited Uses of Publishing and AI Features#

4.1

You must not use the Services' content generation, publishing or search-engine submission features to manipulate search engines or AI systems in breach of their published spam policies or guidelines. In particular, you must not use the Services for:

  • (a)spam, or mass-produced, low-value or auto-generated content created primarily to manipulate search rankings rather than to help users (sometimes called "scaled content abuse");
  • (b)doorway pages, or large numbers of near-duplicate pages targeting variations of keywords or locations that funnel users to a single destination;
  • (c)cloaking, sneaky redirects, hidden text or hidden links, or showing search engines or AI crawlers content different from what users see;
  • (d)keyword stuffing, scraped or spun content, or automatically translated content published without review;
  • (e)link schemes, including buying, selling or exchanging links for ranking purposes, private blog networks, or excessive reciprocal linking, other than participation in the Backlink Network in accordance with its rules in section 10;
  • (f)site reputation abuse ("parasite SEO"), meaning publishing third-party or low-value content on an established site to exploit that site's ranking signals; or
  • (g)submitting URLs to search engines (including through IndexNow or Google Search Console) for pages that breach this Policy or that you do not own or control.
4.2

You must not use the Services to:

  • (a)publish content on any domain, subdomain, website, hosted blog or social account that you do not own or control, or that you are not authorised to publish on;
  • (b)present AI-generated content, images or media without the disclosures or labels required by applicable law, regulation or platform rules, or falsely claim that AI Output was written, reviewed or endorsed by a named human expert;
  • (c)generate or publish election, political or civic content that is deceptive, including false information about voting procedures, candidates or election results, or undisclosed political advertising;
  • (d)create or publish deepfakes or other synthetic or manipulated media that depict real persons saying or doing things they did not say or do, or that could reasonably deceive people about real events, without clear disclosure and the depicted person's consent where required;
  • (e)generate content that breaches the usage policies of the AI model providers used by the Services (see section 8); or
  • (f)attempt to circumvent safety filters, content controls or limits in the Services or in the underlying AI models, including through jailbreaking or prompt manipulation.
4.3

Search engines and AI platforms decide independently how to treat content and links. DCK VISIBILITY 360 does not guarantee that any content generated or published through the Services will comply with their guidelines, be indexed or ranked, or avoid manual or algorithmic action. You bear the risk of any such action.

5. Messaging, Outreach and Direct Marketing#

5.1

You must not use the Services to send, or to facilitate sending, unsolicited commercial messages (spam) by email, SMS, WhatsApp, Telegram, social media messaging or any other channel.

5.2

Where you use the Services to send, schedule or prepare any marketing or outreach communication, you are solely responsible for complying with all applicable anti-spam, direct-marketing and electronic communications laws, including, as applicable:

  • (a)the US CAN-SPAM Act, including accurate header and sender information, non-deceptive subject lines, identification of the message as an advertisement where required, a valid physical postal address, and a working opt-out mechanism honoured within 10 business days;
  • (b)the Malaysian Personal Data Protection Act 2010 (as amended), including the data subject's right under section 43 to require you to stop processing their personal data for direct marketing;
  • (c)the Singapore Personal Data Protection Act 2012, including the Do Not Call Registry provisions for messages to Singapore telephone numbers, and the Singapore Spam Control Act 2007;
  • (d)the EU ePrivacy Directive as implemented in each Member State and the UK Privacy and Electronic Communications Regulations 2003 (PECR), including consent and soft opt-in rules for electronic marketing; and
  • (e)any other law applicable to the sender or the recipient.
5.3

Where WhatsApp or another Meta messaging product is used in connection with the Services, you must comply with the WhatsApp Business Messaging Policy and Meta's commerce and platform terms, including by obtaining the recipient's opt-in before sending business-initiated messages, using only approved message templates where required, clearly identifying your business, and promptly honouring opt-out requests (such as a reply of "STOP").

5.4

You must not:

  • (a)use purchased, rented, harvested or scraped contact lists to send messages through the Services;
  • (b)send messages to people who have opted out or who are on a do-not-call or suppression list that applies to you;
  • (c)use misleading sender names, subject lines or content, or hide the commercial nature of a message; or
  • (d)use the Services to send bulk messages in a way that causes DCK VISIBILITY 360 or its providers to be blocklisted or to receive excessive complaints.

6. Data Protection and Privacy#

6.1

You must not:

  • (a)deploy the Tracking Script on any website without providing Visitors with a privacy notice that describes the analytics and tracking performed, and without obtaining any consent required by law (including under the ePrivacy Directive, PECR or the Malaysian or Singapore PDPA) before the Tracking Script loads, as further described in the Data Processing Agreement;
  • (b)deploy the Tracking Script on websites or pages that you do not own or control, or that are directed at children;
  • (c)configure your websites, forms, URLs or Connected Accounts so that the Services capture special categories of personal data, sensitive personal data, payment card data, government identification numbers or children's data;
  • (d)upload to the Services personal data that you have collected unlawfully or do not have a lawful basis to process, including contact or lead lists obtained in breach of law or of a third party's terms;
  • (e)use the Services to track, profile or monitor individuals in a way that is unlawful, discriminatory or that they would not reasonably expect; or
  • (f)use the Services, AI Output or reports to make decisions about individuals that produce legal or similarly significant effects for them, such as decisions on employment, credit, insurance, housing or access to essential services.
6.2

You are responsible for responding to requests from individuals about personal data that you control. DCK VISIBILITY 360's own handling of personal data is described in the Privacy Policy.

7. Security and Technical Restrictions#

7.1

You must not, and must not allow any person to:

  • (a)scrape, crawl, spider or harvest data from the Services or DCK VISIBILITY 360's websites by automated means, except through APIs or export tools that DCK VISIBILITY 360 makes available for that purpose;
  • (b)copy, modify, decompile, disassemble or reverse engineer any part of the Services, the Apps or the Tracking Script, or attempt to derive their source code, models, algorithms or scoring methods, except to the extent that applicable law expressly permits this despite this restriction;
  • (c)bypass, disable or interfere with any usage limit, quota, rate limit, plan restriction, paywall, licence key, authentication mechanism or security feature;
  • (d)probe, scan or test the vulnerability of the Services or any related system or network, or breach any security or authentication measure, except through responsible disclosure as described in clause 7.2;
  • (e)share account credentials, allow multiple people to use a single user account, or sell, resell, sublicense, rent or provide access to the Services to third parties, except as expressly permitted by your plan or a written agency or reseller agreement with DCK VISIBILITY 360;
  • (f)conduct load testing, stress testing or penetration testing, or send traffic in volumes that impose an unreasonable or disproportionate load on DCK VISIBILITY 360's infrastructure;
  • (g)use the Services, AI Output, reports or any information obtained from the Services to build, train or improve a competing product or service, or to train any machine-learning or AI model;
  • (h)publish or disclose the results of any benchmark, performance or comparative test of the Services without DCK VISIBILITY 360's prior written consent;
  • (i)interfere with or disrupt the integrity or performance of the Services, or the data of other customers, including by uploading malicious code or using the Tracking Script ingestion endpoints to submit false or fabricated data; or
  • (j)create accounts by automated means or under false pretences, or create multiple accounts to evade limits, free-trial or money-back restrictions, suspension or termination.
7.2

Responsible disclosure. If you believe you have found a security vulnerability in the Services, report it promptly and confidentially to privacy@dckvisibility360.com, with enough detail for us to reproduce it. You must not access, modify or delete data that does not belong to you, degrade the Services, or publicly disclose the vulnerability before we have had a reasonable opportunity to fix it. Good-faith reports made in accordance with this clause will not be treated as a breach of clause 7.1. This clause does not create any bug bounty or reward entitlement.

8. Third-Party Platform Compliance#

8.1

The Services connect to and rely on third-party platforms and providers, including Google (Search Console, Analytics, Business Profile and Gemini), Microsoft (Bing Webmaster Tools), Meta (Facebook, Instagram, Threads and WhatsApp), LinkedIn, Telegram, WordPress, Shopify, and AI model providers such as Google, OpenAI, Anthropic and Perplexity. When you use the Services in connection with any of them, you must comply with their terms of service, developer and API policies, advertising and community standards, and usage policies.

8.2

The prohibited uses in the usage policies of the AI model providers used by the Services (including the OpenAI Usage Policies, the Anthropic Usage Policy and the Google Generative AI Prohibited Use Policy) flow down to you and form part of this Policy. Where those policies are stricter than this Policy, the stricter rule applies to content and prompts processed through the relevant provider.

8.3

Third-party platforms may suspend or restrict your accounts, remove your content or revoke DCK VISIBILITY 360's access independently of DCK VISIBILITY 360. DCK VISIBILITY 360 is not responsible for, and is not liable for, any action taken by a third-party platform, and may take any step reasonably necessary to protect its own access to those platforms, including disconnecting your Connected Accounts.

9. AI Visibility Checks#

9.1

When using AI visibility checks, prompt tracking and related features, you must not:

  • (a)submit prompts, brand names, competitor names or topics designed to harass, defame or target any individual, or to generate content about private individuals;
  • (b)use the results to make false or misleading public claims about competitors or about AI platforms;
  • (c)attempt to manipulate the output of third-party AI platforms through prohibited techniques, including prompt injection, hidden instructions or text aimed at AI crawlers on your own or third-party web pages, data poisoning, or coordinated fake content intended to distort AI answers; or
  • (d)use the features to extract, copy or reproduce the underlying AI models, or to circumvent the providers' rate limits or terms.
9.2

AI visibility results are point-in-time samples and estimates. Their limitations are described in the AI Disclaimer.

11. Agencies, Resellers and Client Accounts#

11.1

If you use the Services on behalf of clients, you are responsible for ensuring that each client, and each client website, account and item of content managed through your account, complies with this Policy. You must obtain each client's authorisation before connecting its accounts, deploying the Tracking Script on its sites or publishing on its behalf.

11.2

A breach of this Policy by or in relation to any of your clients is treated as your breach. DCK VISIBILITY 360 may take enforcement action against your entire account, or only against the affected client workspace or site, at its discretion.

12. Monitoring and Enforcement#

12.1

DCK VISIBILITY 360 may, but is not obliged to, monitor, review or screen content and activity on the Services, including through automated tools. DCK VISIBILITY 360 has no obligation to detect breaches, and the absence of action does not mean that content or activity complies with this Policy or the law.

12.2

If DCK VISIBILITY 360 believes, in its reasonable discretion, that you or any User have breached or are likely to breach this Policy, or that content or activity creates a risk of harm or liability, DCK VISIBILITY 360 may take any one or more of the following actions:

  • (a)issue a warning or request that you remove or modify content;
  • (b)remove, unpublish, block or disable access to any content, including content on hosted blogs;
  • (c)disable Auto-Publish mode and require that content be held for Review;
  • (d)disconnect Connected Accounts, disable the Tracking Script, remove your sites from the Backlink Network, or restrict specific features;
  • (e)suspend your account or any User's access, in whole or in part;
  • (f)terminate your account and the Agreement in accordance with the Terms of Service, without refund of any fees paid, to the maximum extent permitted by applicable law;
  • (g)report the matter to, and co-operate with, law-enforcement authorities, regulators and affected third parties, including disclosing information about you and your use of the Services where DCK VISIBILITY 360 reasonably believes this is required by law or necessary to prevent harm; and
  • (h)co-operate with third-party platforms, AI providers, search engines and hosting providers in their investigations and enforcement.
12.3

DCK VISIBILITY 360 will usually give notice and an opportunity to remedy before taking action under clause 12.2(e) or (f) where the breach is capable of remedy. However, DCK VISIBILITY 360 may act immediately and without prior notice where it considers the matter urgent, including where there is a risk of harm to any person, a security threat, illegal content, a legal or regulatory requirement, or a risk to DCK VISIBILITY 360's relationship with a third-party provider.

12.4

Enforcement action does not relieve you of your obligation to pay fees that have accrued or are payable. Money-back eligibility is void where you have breached this Policy, as described in the Refund Policy.

13. Reporting Abuse and Notice-and-Takedown#

13.1

To report content or activity that you believe breaches this Policy, email privacy@dckvisibility360.com with the subject line "Abuse report", the URL or location of the content, and a description of the issue. DCK VISIBILITY 360 will review reports in good faith but does not undertake to act on every report or to respond within any particular time, except where the law requires.

13.2

Intellectual property notices. If you believe content hosted, published or transmitted through the Services infringes your copyright or other intellectual property rights, send a written notice to privacy@dckvisibility360.com that includes:

  • (a)your name, address, telephone number and email address;
  • (b)identification of the copyright work or other right claimed to be infringed;
  • (c)identification of the allegedly infringing material, with the URL or other information sufficient to locate it;
  • (d)a statement that you are the owner of the right or authorised to act on the owner's behalf;
  • (e)a statement that you have a good-faith belief that the use of the material is not authorised by the owner, its agent or the law;
  • (f)a statement that the information in the notice is accurate; and
  • (g)your physical or electronic signature.
13.3

On receipt of a notice that substantially complies with clause 13.2, DCK VISIBILITY 360 will remove or disable access to the material within the time required by applicable law, including the service-provider notification framework in Part VIB of the Malaysian Copyright Act 1987 and, where applicable, equivalent regimes in other jurisdictions such as the US Digital Millennium Copyright Act. DCK VISIBILITY 360 will take reasonable steps to notify the Customer responsible for the material.

13.4

Counter-notices. If your material was removed and you believe that it was removed by mistake or that you have the right to use it, you may send a counter-notice to privacy@dckvisibility360.com identifying the material, explaining why it should be restored, confirming the accuracy of your statement and consenting to the jurisdiction of the relevant courts. Where applicable law permits, DCK VISIBILITY 360 may restore the material after the period prescribed by that law unless the complainant informs DCK VISIBILITY 360 that it has commenced legal proceedings. DCK VISIBILITY 360 is not obliged to restore any material that it considers breaches this Policy.

13.5

Repeat infringers. DCK VISIBILITY 360 will, in appropriate circumstances and at its discretion, suspend or terminate the accounts of Customers and Users who are repeat infringers of intellectual property rights.

13.6

Knowingly submitting a false or misleading notice or counter-notice may expose you to liability. DCK VISIBILITY 360 may share notices, including the sender's contact details, with the affected Customer and with organisations that collect and publish takedown notices, except where the law prevents it.

14. Consequences and Liability#

14.1

You are solely responsible for all content and activity on your account and for any consequences of breaching this Policy, including actions taken by third-party platforms, search engines, regulators or affected individuals.

14.2

To the maximum extent permitted by applicable law, you will defend, indemnify and hold harmless DCK VISIBILITY 360, its Affiliates and their respective officers, directors, employees and agents from and against all claims, losses, damages, liabilities, fines, penalties, costs and expenses (including reasonable legal fees) arising out of or relating to your or your Users' or clients' breach of this Policy, or any content published, sent or made available through your account.

14.3

To the maximum extent permitted by applicable law, DCK VISIBILITY 360 is not liable to you or any third party for any action it takes, or decides not to take, in good faith under this Policy, including the removal of content or the suspension or termination of accounts.

15. Changes to this Policy#

15.1

DCK VISIBILITY 360 may update this Policy from time to time to reflect changes in the law, the Services, third-party platform policies or emerging risks. The updated Policy will be published on this page with a new "last updated" date. Where changes are material, DCK VISIBILITY 360 will give reasonable notice by email or in-app notice, unless the change is required urgently by law, a regulator or a third-party platform.

15.2

Your continued use of the Services after an updated Policy takes effect constitutes acceptance of it.

16. Contact#

16.1

Questions about this Policy, abuse reports, intellectual property notices and security reports should be sent to privacy@dckvisibility360.com. General support questions can be sent to support@dckvisibility360.com.

16.2

This Policy is subject to the governing law and dispute-resolution provisions of the Terms of Service.
